Timothy L. Webster has been practicing health law for 25 years, in both in-house and private practice settings. He has been a member of Brown & Fortunato’s Health Care Group since 2000. Tim is a member of the American Health Lawyers Association and is Board Certified in Health Law by the Texas Board of Legal Specialization.
Tim has many years of experience with anti-kickback and Stark law issues, and regularly advises clients on structuring transactions and arrangements to comply with those laws. He counsels home medical equipment companies, pharmacies, hospitals, physician practices and diagnostic facilities on fraud and abuse issues, regulatory compliance, and Medicare coverage and payment matters.
Tim’s prior experience as an in-house hospital lawyer has proven invaluable to the firm’s hospital clients. He advises them on payment issues, joint ventures, physician recruitment and managed care contracting. He has been engaged to act as an Independent Review Organization under the Corporate Compliance Agreements of two hospitals and a physician practice. He conducted a HIPAA breach audit for a hospital client, and regularly advises on HIPAA compliance issues.
Tim has negotiated acquisitions and other transactions on behalf of both large and small clients, structuring the transactions to meet client needs while remaining compliant with legal and regulatory requirements.
Tim began his legal career at Dechert Price & Rhoads in Philadelphia, where he represented health care and business clients in transactional and corporate matters, and also advised on health care regulatory issues. After five years, Tim left Dechert to become Associate Counsel at Graduate Health System in Philadelphia, an integrated health care delivery system of seven hospitals, several ancillary provider entities, and a health maintenance organization. After a year he became Director of Legal Affairs for the system. His responsibilities included tax-exempt organization issues, fraud and abuse advice, and joint ventures and other transactions.
Tim returned to private practice with Alice G. Gosfield and Associates, a nationally known boutique health law firm, where he represented physicians and other providers in payment and regulatory matters, with an emphasis on Medicare Part B issues. After working at Gosfield and Associates, Tim returned to in-house practice as Associate Vice President, Legal Affairs of Mercy Health System of Southeastern Pennsylvania, which operated five hospitals in Philadelphia and the surrounding area as well as a home health company, a physician network and Medicaid HMO partnerships in several states. While at Mercy, he had principal responsibility for regulatory, payment and compliance matters and also negotiated and documented major corporate transactions.
Tim was born in Lewisburg, Pennsylvania. He graduated from Harvard College in 1971, and received his J.D. magna cum laude from Temple University School of Law in 1987.
He is married to Jennie Sparks, a Certified Occupational Therapy Assistant who works with preschool and elementary school students. They enjoy travel and outdoor activities.
