Marian joined Brown & Fortunato in 2011, as a member of the firm’s Health Care Group. Prior to her relocation to Amarillo, Marian was Assistant Vice President, Chief Compliance Officer and Senior Attorney for a hospital system in Florida.
Marian has devoted most of her more than 30 years of law practice to the representation of healthcare providers. She has served as in-house counsel for two major national healthcare systems and as chief compliance officer for a community health system. Marian has also practiced in major national law firms, representing a wide range of healthcare clients, including hospitals and health systems, physicians and physician groups, ambulatory surgery centers, diagnostic facilities, home health companies, ambulance companies, home medical equipment suppliers, pharmaceutical companies and other service providers.
Marian assists these clients in regulatory, operational and transactional matters. Her areas of experience include anti-kickback and physician self-referral laws, Medicare and Medicaid reimbursement, HIPAA and other federal and state privacy and security laws, EMTALA, Medical Staff issues, requirements for tax-exempt entities, responding to investigations and audits by regulatory bodies, structuring relationships between providers, negotiating and drafting contracts, compliance with accreditation standards and Medicare Conditions of Participation, and regulation of clinical research and IRB matters.
Marian was born in Lamesa, TX, and grew up in Amarillo. She earned her BA and MA in Sociology from Texas Tech University. While an undergraduate, she spent a year at the University of Bonn, Germany. After earning her MA, she worked as a social science researcher at the University of Texas Center for Energy Studies before going to Harvard Law School, where she earned her JD. She clerked for the Massachusetts Supreme Judicial Court, and she taught Legal Research and Writing at Boston University School of Law.
Marian is licensed to practice law in Massachusetts, California, Florida and Texas. She is Board Certified in Health Law by the Florida Board of Legal Specialization and Education, and she served as a member of the Florida Bar Health Law Certification Committee for three years. Marian has been listed in Florida “Super Lawyers.” She is an active member of the American Health Lawyers Association. While in Florida, Marian provided pro bono legal services and served on the Board for a not-for-profit company created to establish and operate free medical clinics for the uninsured, staffed by volunteer physicians and other providers. She has volunteered in other areas, including delivering Meals on Wheels, serving as a reading mentor for elementary school children, and assisting with animal adoptions at the Humane Society.
Marian has two grown children. She enjoys reading, travel, hiking and exploring nature trails and wildlife preserves.
